Applicant Annuls Judicial Review on President’s Salary

JAKARTA (Yosefardi) – The Constitutional Court granted judicial review annulment filed by Awaluddin. The petitioner previously disputed Law No 7/1978 regarding President, VP, former President and former VP Financial Right. “Granted the applicant’s annulment registered with No 76/PUU-XI/2013. The applicant is also losing his right to file judicial review of Law No 7/1978,” said Constitutional Judge Akil Mochtar. Previously Awaluddin, represented by his lawyer Bambang Gatot Suchayo, objected the state‘s obligation to bear President, VP, and the former presidents and VP’s allowance. He requests the Constitutional Court to annul related article from the regulation. Given the state’s mounting debt and the high level of poverty, the state should retract the rights to financially provide President, VP and their predecessors, he argues. Awaluddin also said, referred to the article 34 of the Constitutional, the state has an obligation to take care of the poor and neglected children....

Police: KPK Has no Authority to Investigate Labora Sitorus

JAKARTA (Yosefardi) – National Police claimed investigation over Adj. First Inspector Labora Sitorus is not the authority of The Corruption Eradication Commission (KPK). Sutarman, Police chief of detective, argued that Labora case, related to allegation over illegal logging and illegal oil business, had been investigated and ready for trial as the case’s dossiers was completed. Ahmad Yani, Commission III lawmaker, also reminds National Police and State Prosecutor to settle the case, otherwise KPK could take over the case. Police Wants Wider Terrorism Law

JAKARTA (Yosefardi) – National Police wants a wider authority of counter-terrorism action. The lawmakers and government are urged to revise Anti-terrorism Law No 15/2013. In the hearing with Commission III of the House, Timur Pradopo, national police chief, specifically said that the law needs to be revised. Timur claimed that the current regulation do not give the authority to the law enforcement officer to initiate an action on terrorism activity. On Sep. 16, 2013, Timur shared its opinion that the recruitment process and military training should be mentioned in the law revision. Timur also requested the lawmaker to include the intelligence data into category of court evidences. Timur also explained that one of the obstacles to eradicate terrorism activity is the lack of people’s awareness on criminal activities....

Bakrieland PKPU’s Trial Continues

JAKARTA (Yosefardi) – Central Jakarta Commercial Court continues trial of Postponement of Debt Settlement Obligation (PKPU) petition against PT Bakrieland Development Tbk on Sep. 16, 2013. The applicant and respondent were still disputing court’s jurisdiction. Bank of New York Mellon, the PKPU petition, denied that the petition should be filed in the England and Wales jurisdiction, as plead by Bakrieland. The bank’s legal representatives believe that England and Wales’ jurisdiction are not absolute. The bank also claimed that Bakrieland’s denial on the trust deed related to the debt shows the company’s bad faith. In the previous trial, Bakrieland insisted that trustee did not have any legal standing in the case. The case started with Equity-linked obligation issued by BLD Investments Pte Ltd for US$155 million on Mar. 23, 2010. The bond, carries annual interest of 8.625%, will mature in March 23, 2015....

PPATK Submits More Evidences for Graft Cases in Energy Sector to KPK

JAKARTA (Yosefardi) – The anti money laundering body PPATK continues to assist The Corruption Eradication Commission (KPK) for solving the graft cases in energy sector. Recently PPATK have submitted more evidences of SKK Migas-related graft cases. Muhammad Yusuf, Chief of PPATK, came to KPK office in South Jakarta, Sep. 16, 2013, to submit more investigation results about suspicious transaction in the case. However, Yusuf refused to reveal any details on new evidences. Earlier in this month, PPATK has also submitted report of graft suspect Rudi Rubiandini’s suspicious transaction to KPK.
