JAKARTA (Yosefardi) – The Corruption Eradication Commission (KPK) has not yet decided to file a case review (PK) to the Supreme Court (MA) against the verdict from the South Jakarta District Court that granted a pre-trial petition from Police Comr. Gen. Budi Gunawan.

KPK’s acting deputy chief Johan Budi SP said KPK leaders are still discussing the matter. While acting KPK Chief Taufiequrrahman Ruki, as quoted by Kompas.com, recently shared his views that KPK has no authority to file a case review against a pre-trial petition’s verdict.

Similar to Ruki, the Supreme Court’s Spokesperson Suhadi mentioned about Article 263 paragraph 1 of the Criminal Code Procedures (KUHAP) that stipulates a case review can be only filed by the convict or its inheritee.

Supports to the KPK to file a case review to the Supreme Court, meanwhile, come from various parties, especially anti-corruption activists and civil society groups.

As reported earlier, judge Sarpin Rizaldi of the South Jakarta District Court ruled KPK’s decision to name Budi Gunawan as a graft suspect is baseless and illegitimate. (haryantosuharman@yosefardi.com)
