JAKARTA (Yosefardi) – The Constitutional Court has accepted the judicial review filed by Antasari Azhar, former Chief of the Corruption Eradication Commission (KPK), over the Criminal Code Procedures (KUHAP).
Antasari, the murder, opts to seek for justice by filing a new case review on his murder case to the Supreme Court.
Antasari was sentenced 18 years for masterminding the murder of Nasrudin Zulkarnaen in March 2009. Nasrudin was director of PT Putra Rajawali Banjaran, a subsidiary of state-owned Rajawali Nusantara Indonesia (RNI).
Both the High Court and Supreme Court rejected Antasari’s appeals and affirmed the lower court verdict. Antasari then filed a case review to the Supreme Court with proposed three novums and forty-eight mistakes of the judges in his trial. But on Feb. 13, 2012, the panel of supreme judges rejected Antasari’s case review, a final Antasari’s legal attempt to get freedom and justice.
The Supreme Court’s ruling to reject Antasari’s case review was criticized as people believed Antasari is not guilty. Nasrudin’s family even also expressed their hopes that Antasari will be released from prison and all charges soon. The Judicial Commission (KY), meanwhile, issued a recommendation to the Supreme Court to evaluate three judges in Antasari’s trial at the district court level whose proven for committing ethical violations.
Other than Antasari case, now people started to rise question about how many people will file a case review to the Supreme Court following the newly Constitutional Court ruling. (haryantos@yosefardi.biz)
