Supreme Court Acquits Prita from Defamation against Omni Hospital

JAKARTA (Indonesia Today) ??? Prita Mulyasari, convict of defamation against Omni International Hospital, finally got an acquittal verdict. Supreme Court, in the judicial review, finds Prita not guilty. Ridwan Mansyur, Public Relation of Supreme Court, revealed that the judges considered Prita???s email regarding her complaint of Omni International???s service is not a defamation. The verdict was registered under number 22 PK/Pid.Sus/2011, Kontan.co.id reported. The judicial review was filed based on Prita???s novum (new evidences) on the case. The judges, consisted of Djoko Sarwoko, Surya Jaya, and Suhadi, also declared restoration of Prita???s right, status, and dignity. The case started when Prita sent an e-mail to her friends complaining about Omni International Hospital???s bad service. The hospital then found the email and filed civil and criminal lawsuit against her. District court then declared Prita not guilty in 2009. The decision, however, was overruled by Supreme Court on the cassation and dropped her six months imprisonment. Court Rejects Lebong Tandai Lawsuit against Avocet

JAKARTA (Indonesia Today) ??? PT Lebong Tandai???s lawsuit against Avocet Mining Plc cannot be accepted as South Jakarta District Court judges declared the court does not have the authority to adjudicate the dispute, Wednesday (Sep 19). ?? In the interlocutory decision, presiding judge Suhartoyo granted the defendant???s plea that demands the court to reject the case. Hotman Paris Hutapea, lawyer of Avocet, has earlier stated that the case should have been brought to arbitration board, instead of a district court. Lebong Tandai (PTLT), a subsidiary of Merukh Enterprises, filed a lawsuit against Avocet Mining PLC. Claiming Avocet Mining had violated shares purchase agreement, Lebong Tandai demands a US$2.1 billion compensation. Lebong Tandai also included J&Partners Asia Ltd, J Resources Nusantara (formerly PT Bara Kutai Energi), and J Resources Asia Pasifik Tbk as the second, third and fourth defendant respectively. PT Lebong Tandai claimed that Avocet infringed its rights by entering PT Avocet Mining Mongondow (PTABM) into shares purchase transaction with J Resources Nusantara, while PTLT stated Avocet has agreed to sell it to the company. According to PTLT, work contract between the company and Avocet Mining PLC gives PTLT first right of refusal in the share purchase, which regulated that before transferring the share to other parties, Avocet should offer the shares to PTLT. Harry Tanoe to Testify in Graft Case

JAKARTA (Indonesia Today) ??? Hary Tanoesoedibjo, President Director of PT Bhakti Investama and politician from National Democrat Party (Nasdem), will testify before the court in the trial of a bribery allegation against Bhakti Monday (Sep 24). Hary will be testifying as witness for bribery defendant James Gunardjo, a businessman reportedly related to Bhakti. Prosecutor from the antigraft commission KPK summoned Hary to testify as they asses the businessman could give some information regarding the case. Hary Tanoesoedibjo has earlier been questioned by KPK on the graft allegation case. He, in several occasions, denied the allegation and said that there is an attempt to connect his name with the tax graft allegation. Harry underlined that it was a political move. KPK, however, dismissed allegations of political motives behind the scheduled examination of the businessman and politician from Nasional Demokrat Party. KPK spokesperson Johan Budi SP said KPK needs to examine Harry because investigators believe he knows something about the case being investigated Besides Hary, KPK was alsoquestioned BHIT Director Wandy Wira Riady and BHIT Commissioner Antoniues Z Tonbeng. The graft case has named taxman Tommy Hindratno and businessman reported related to BHIT James Gunardjo. Lawmaker Dies from Car Accident

SIDOARJO (Indonesia Today) – Theodorus Jacob Koekerits, lawmaker of Commission I (overseeing international and military affairs) from PDI-P, has died in a car accident, Monday (Sept 24).?? Tribun News reported Theodorus???s car was headed to Surabaya from Tulungagung, East Java. The late lawmaker reportedly tried to catch an early flight. Suspect in $650 Million Scam Died in Detention Center

JAKARTA (Indonesia Today) ??? Jaya Komara, suspect of Rp6 trillion (US$650 million) scam and owner of the troubled Langit Biru cooperative, has reportedly died in the detention center of Tangerang Police, Banten province. Sutarman, head of criminal investigation department of the national police, confirmed that the scam suspect has died, Thursday (Sep 13). Sutarman, however, yet to find the cause of Jaya Komara???s death. Jaya Komara was arrested in Purwakarta, West Java, on Tuesday (Jul 24) after he was named a fugitive for months. Numbers of Jaya Komara???s investors have filed a lawsuit against him, demanding him to pay Rp100 million compensation each. Jaya Komara, has been named suspect in the Rp6 trillion or about US$640 million fraud related to his Langit Biru cooperative. Jaya could be charged with fraud and money laundering allegation. However, if police will use money laundering law, then they should be able to prove the funds deposited by the local people were wrongly used. Police have earlier stated that the cooperative, which was established in January 2011, has accumulated ???investment??? funds amounting Rp6 trillion. The number is the total investment of 125,000 members of the cooperative until October 2011....
