JAKARTA (Yosefardi) – Three law experts reportedly will submit a request to the Constitutional Court (MK) to judicial review the Law No. 2/2002 regarding the National Police. They are Denny Indrayana, Zainal Arifin Mochtar, and Saldi Isra.

Zainal explained that the judicial review request over the National Police Law is needed to strengthening the presidential system. He said the authority to choose new Chief of the National Police should be returned to become the prerogative right of the President.

Zainal shared his views that Article 11 Paragraph 1 of the Law 2/2002 allegedly violates Article Article 4 Paragraph 1 of the 1945 Constitution.

Article 11 Paragraph 1 of the Law 2/2002 itself reads, “the appointment and the dismissal of new Police Chief by President should get an approval of the House of Representatives (DPR)”.

The polemic over the election of new Police Chief continues following the decision of President Joko “Jokowi” Widodo to postpone the inauguration of Comr. Gen. Budi Gunawan as new Police Chief though the DPR has accepted Budi Gunawan’s nomination.

President Jokowi decided to postpone Budi Gunawan’s inauguration as his response to the decision of the Corruption Eradication Commission(KPK) to name the three-star police general as a graft suspect. (haryantosuharman@yosefardi.com)
