JAKARTA (Yosefardi) – The Constitutional Court (MK) has on Monday (Sep. 29) fully rejected a request of judicial review on the newly revised Legislative Institution Law (also known as the MD3 Law) No. 17/2014, paving the way for Prabowo Subianto’s Red-and-White coalition to fully control the 2014-2019 House of Representatives (DPR).
The court’s verdict, however, also contained dissenting opinion from two MK justices, Maria Farida Indrati and Arief Hidayat who said MK supposedly granted PDI-P’s judicial review. Other 7 MK justices rejected.
As reported earlier, PDI-P demanded the court to review some articles in the newly revised law, especially Article 84 of the law, which regulates a voting mechanism to select the next Speaker of the House, instead of automatically granting the position to PDI-P as the winner of 2014 legislative election.
Under the newly revised MD3 Law, the mechanism to elect the package of the next Speaker of the House along with its four deputies will be conducted through a voting. Similar mechanism will be applied for the election of the leadership of 11 commissions and other bodies within the DPR.
Prabowo’s Red-and-White coalition that consists of five political parties will control majority seats with 292 out of 560 seats at the 2014-2019 DPR (52.14%). That five parties are Gerindra, Golkar, PKS, PAN, and PPP. (haryantos@yosefardi.biz)
