JAKARTA (Yosefardi) – Condro Widjojo, local businessman, is currently facing trademark dispute against Japanese-based company Yamazaki Baking Co. Ltd. The foreign company accused Condro unlawfully using “Yamazaki” brand for his business product.

Before panel of the judges, legal representative of Yamazaki argued that his client’s brand is a well-known brand and has been registered since 1977 in number of countries. However, when it will be registered in Indonesia, the brand name and logo is already used by Condro.

Yamazaki accused that Condro has brrn trying to ride the company’s brand. The brand registration by Condro, the plaintiff argued, will also potentially cause a confusion for the customers.

On the other hand, Condro’s lawyers claimed that their client has been using the Yamazaki brand since Aug. 1, 2013. In the 30 years using the brand, according to the defendant, the registration has been renewed twice and had never received any objection from the Intellectual Property Right Directorate General.

Moreover, Condro considered that the Japanese company has violated the law with established an agreement with PT Sumber Alfaria Trijaya Tbk to produce Yamazaki’s bakery. Condro, therefore, filed a counterclaim and seeks for Rp10 billion compensation for immaterial loss. (indrab@yosefardi.biz)
